New York – Two new exclusions on tariffs should benefit some importers of home textiles, according to the Home Fashions Product Association (HFPA).

In an alert to members today, association legal counsel Robert Leo said the U.S. Trade Representative (USTR) is expected this week to publish new exclusions from tariff List 4A that will benefit importers of some down, pillow and comforter shells items.

“Importers of these specific products will not have to pay the 7.5% duty going forward and are eligible for refunds of the duty paid (@15% or 7.5%) since September 1, 2019,” wrote Leo, partner at Meeks, Sheppard, Leo & Pillsbury.

He cautioned that the exclusions will only be in effect until Sept. 1 of this year.

The exclusions and the HTS subheadings include:

  • Down of ducks or geese, not further worked than cleaned, disinfected or treated for preservation, meeting both test standards 4 and 10.1 of Federal Standard 148a promulgated by the General Services Administration, with a fill power of at least 315 cm3/g but not more than 580 cm3/g (described in statistical reporting number 0505.10.0055)
  • Shells for pillows and comforters made from microfiber fabric consisting of filament yarns not more than 1.22 decitex, such fabric with a weight of at least 55 g/m2 but not more than 155 g/m2 (described in statistical reporting number 6307.90.9889)

“Duty refunds are not automatic and in order to obtain them you must either file Post Summary Changes (PSCs) for entries not liquidated (finalized) yet or protests for those entries already liquidated, said Leo. “Your customs broker can file the PSCs and protests.”

PSC and protests must state precisely why the entry is entitled to a refund, including citing to the official exclusion notice, he added.
